1. Agreement to these terms
These Terms & Conditions ("Terms") form a binding agreement between you and WebsitePuzzle ("WebsitePuzzle", "we", "us", "our") regarding BusinessMail("Service"). By creating an account, accessing the Service, or clicking to accept where presented, you agree to these Terms and our Privacy Policy.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes the organization.
If you do not agree to these Terms, do not use the Service.
2. The service
BusinessMail by WebsitePuzzle provides business email tools including webmail, conversation views, compose and send, optional platform-hosted mailboxes, optional connection to external IMAP/SMTP (BYOM), team administration, domain verification, security features, and related functionality. Features may vary by plan, configuration, and rollout status.
We may offer beta, preview, or experimental features. Such features are provided as-is, may change or be withdrawn at any time, and may be less reliable than generally available features.
3. Eligibility & accounts
You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for all activity under your account and for maintaining the confidentiality of credentials, API keys, and two-factor devices.
You must provide accurate registration information and keep it current. You must promptly notify us of unauthorized access at postmaster@websitepuzzle.com.
Workspace owners and administrators are responsible for inviting users, assigning roles, configuring domains, and ensuring their organization's use complies with these Terms and applicable law.
4. Acceptable use
You agree not to, and not to allow others to:
- Send spam, phishing, malware, fraud, harassment, or unlawful content
- Probe, scan, or test the vulnerability of systems without authorization
- Interfere with or disrupt the Service, other users, or network infrastructure
- Circumvent rate limits, authentication, access controls, or anti-abuse measures
- Use the Service to infringe intellectual property, privacy, or other rights
- Resell, sublicense, or provide the Service to third parties except as expressly permitted by your plan
- Harvest addresses or metadata for unsolicited communications
- Misrepresent sender identity or manipulate email authentication records in bad faith
We may investigate suspected violations, filter or block messages, suspend accounts, and cooperate with law enforcement or abuse responders. We are not obligated to monitor all content but may do so for security and compliance.
5. Your content & mail
You retain ownership of content you submit, upload, or transmit through the Service ("Customer Content"), including email messages and attachments. You grant us a worldwide, non-exclusive license to host, store, reproduce, process, transmit, display, and otherwise use Customer Content solely as necessary to provide, secure, and improve the Service and as described in our Privacy Policy.
You are solely responsible for Customer Content and for obtaining all rights and consents needed to use, store, and transmit it through the Service. We do not endorse Customer Content and are not responsible for its accuracy, legality, or appropriateness.
6. BYOM & third-party mail
If you connect external mail providers, you do so at your own risk. We are not responsible for availability, deliverability, data loss, policy enforcement, or security incidents originating at third-party providers, internet paths, or recipient systems.
You represent that you have authority to connect those systems and that doing so does not breach any third-party agreement. We may store credentials and synced content as needed to operate BYOM features.
7. Plans, billing & taxes
Paid plans, if any, are described on our pricing pages or in an order form. Fees are due as stated at purchase. Unless otherwise specified, subscriptions renew automatically until canceled. We may change prices on reasonable notice; continued use after the effective date constitutes acceptance of new pricing for renewal periods.
Except where required by law, fees are non-refundable. You are responsible for applicable taxes. Failure to pay may result in suspension or downgrade.
8. Availability, maintenance & changes
We strive for reliable operation but do not guarantee uninterrupted, timely, secure, or error-free service. The Service may be unavailable due to maintenance, upgrades, outages, force majeure, or factors outside our reasonable control.
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
Without limiting the foregoing, we do not warrant that:
- Email will be delivered, received, or stored without loss, delay, or corruption
- Spam, virus, or phishing filtering will detect all threats
- Search results or smart categorization will be complete or accurate
- The Service will meet your requirements or integrate with all third-party systems
- Defects will be corrected within any particular timeframe
Any oral or written advice from us or our personnel does not create any warranty not expressly stated in these Terms.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL WEBSITEPUZZLE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR REPUTATION, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).
Some jurisdictions do not allow exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the greatest extent permitted by law.
You acknowledge that email and internet communications inherently involve third parties and failure modes outside our control, and that limitations in this section are a fundamental basis of the bargain between you and us.
11. Indemnification
You will defend, indemnify, and hold harmless WebsitePuzzleand its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use or misuse of the Service
- Customer Content or mail sent or received through your account
- Violation of these Terms or applicable law
- Infringement or misappropriation of third-party rights
- Disputes between you and your users, customers, or recipients
We may assume exclusive defense and control of any matter subject to indemnification at your expense, and you agree to cooperate with our defense.
12. Suspension & termination
You may stop using the Service at any time. We may suspend or terminate access immediately, with or without notice, if we reasonably believe you violated these Terms, pose a security or abuse risk, fail to pay fees, or where required by law.
Upon termination, your right to use the Service ceases. We may delete or retain data as described in our Privacy Policy, including a post-deletion retention period of up to approximately 6 months for recoverable mailbox data unless a shorter erasure is approved or required by law.
Sections that by their nature should survive termination will survive, including disclaimers, limitation of liability, indemnification, and general provisions.
13. Privacy
Our collection and use of personal data is described in the Privacy Policy, incorporated into these Terms by reference. If there is a conflict between these Terms and the Privacy Policy regarding data processing, the Privacy Policy controls for that subject matter.
14. General provisions
Governing law
These Terms are governed by the laws applicable where WebsitePuzzle is established, without regard to conflict-of-law rules, except where mandatory consumer protections in your jurisdiction apply.
Disputes
Except where prohibited, you agree that exclusive jurisdiction for disputes relating to these Terms or the Service lies in the courts where WebsitePuzzle is established, and you consent to personal jurisdiction there. Nothing prevents us from seeking injunctive relief in any competent court.
Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
Entire agreement
These Terms, together with the Privacy Policy and any order or plan description expressly referenced, constitute the entire agreement regarding the Service and supersede prior or contemporaneous understandings on that subject.
Severability & waiver
If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
Force majeure
We are not liable for delay or failure due to events beyond our reasonable control, including internet or utility failures, labor disputes, natural disasters, war, government action, or third-party service outages.
